If you are pregnant and working in Belgium, you are entitled to maternity leave - but how long is the leave, and when can you take it?
Here is a simple overview of how pre-natal and post-natal leave works in Belgium - especially useful if you have just moved here and are still figuring things out.
Information to Know
Pre-Natal Leave
Duration & Period: Up to 6 weeks before due date
- Only 1 week is mandatory - you must stop working 1 week before your expected delivery date
- The other 5 weeks are flexible for BEFORE BIRTH, AFTER BIRTH, PART BEFORE-PART AFTER
In case your baby is born later than expected, your pre-natal leave is extended until the actual birth.
Post-Natal Leave
Duration & Period: 9 weeks after birth
- 9 weeks are mandatory after giving birth
During this period, your employer cannot ask you to work even if you feel ready to return.
FAQ about Maternity Leave
Can I extend my leave?
Simple answer: Yes, if you did not use all 5 optional pre-natal weeks, you can add them after your 9-week post-natal leave.
What other information should I know?
- You cannot be asked to work overtime while pregnant
- Your job is protected during maternity leave. You cannot be fired for taking the legal leave.
